These terms of use (hereinafter the "Terms") govern access to and use of the MagicListe service, available at magicliste.fr (hereinafter the "Service"), published by a natural person (hereinafter the "Publisher").
Use of the Service implies full and unreserved acceptance of these Terms. If you do not accept these terms, you are advised not to use the Service.
MagicListe is a free service for creating and sharing gift lists online, primarily (but not exclusively) intended for baby registries.
The Service notably allows you to:
— Create a gift list by entering basic information (first name, email, recipient's first name).
— Add gifts by pasting product links from third-party online stores.
— Customize the list (cover photo, welcome message, delivery address).
— Share the list via a unique link.
— Allow loved ones to declare that they are giving a gift or to contribute to a gift pool.
The Service is provided free of charge, with no registration fee or commission charged to the user. The Publisher reserves the right to offer optional paid features in the future, without this affecting the existing free features.
Some links to online stores featured in the gift lists are affiliate links. When a purchase is made via one of these links, MagicListe may receive a commission from the partner store, through the Amazon, Awin and Effinity affiliate networks. This commission entails no additional cost for the buyer and influences neither the ranking nor the selection of products in the lists.
Use of the Service does not require the creation of an account in the traditional sense. Access to the management of a list is secured by a magic link system sent by email (passwordless authentication).
The user is responsible for the confidentiality of their access link. Any access made using this link is deemed to have been carried out by the user themselves.
Viewing a public list by loved ones (guests) requires no registration or authentication.
Important note
MagicListe is not a payment service, a payment institution, or a financial intermediary within the meaning of the applicable banking and financial regulations.
The gift pool feature allows guests to declare an intention to make a financial contribution toward a gift. This declaration constitutes a moral commitment between the guest and the list creator, and not an enforceable contractual commitment.
No money passes through MagicListe. Actual settlement of contributions takes place directly between the contributor and the list creator, outside the platform, using the payment method of their choice (PayPal, Lydia, bank transfer, cash, etc.).
The Publisher cannot be held liable for the non-payment, partial payment or late payment of a contribution declared on the platform, nor for any dispute between a creator and a contributor relating to the settlement of a contribution.
The products displayed in the lists come from third-party online stores. MagicListe automatically extracts certain information (title, price, image) from the links provided by users.
The Publisher does not guarantee the accuracy, completeness or timeliness of this information. Prices, availability and product characteristics may vary. Users are advised to verify this information directly on the merchant's website before any purchase.
MagicListe cannot be held liable for the quality, conformity, delivery or after-sales service of products purchased from third-party stores. Any complaint relating to a product must be addressed directly to the relevant merchant.
Some links to third-party stores may contain affiliate identifiers. The use of these links is transparent and does not affect the price paid by the buyer.
The user undertakes to:
— Provide accurate and up-to-date information when creating their list.
— Not use the Service for unlawful, fraudulent purposes or purposes contrary to public morals.
— Not publish unlawful, defamatory, abusive, pornographic or hate-inciting content.
— Not use the Service to raise funds fraudulently.
— Not attempt to disrupt the operation of the Service (cyberattack, overload, etc.).
— Respect the intellectual property rights of third parties.
In the event of a breach of these obligations, the Publisher reserves the right to suspend or delete the list concerned, without notice or compensation.
The processing of personal data is described in the privacy policy, which forms an integral part of these Terms.
The Publisher endeavors to ensure the availability of the Service 24/7, but cannot guarantee permanent availability. The Service may be interrupted for reasons of maintenance, updates or any other technical reason, without this giving rise to any compensation.
The Publisher reserves the right to modify, suspend or discontinue the Service, in whole or in part, at any time and without notice. In the event of a permanent discontinuation of the Service, users will be informed by email within a reasonable time so that they can retrieve their data.
The Service is provided "as is", without warranty of any kind, express or implied. The Publisher cannot be held liable for any direct or indirect damage resulting from the use of, or inability to use, the Service.
In particular, the Publisher disclaims all liability in the event of data loss, Service interruption, technical malfunction, or any harm related to transactions between users and third-party stores or between creators and contributors.
The Publisher's liability is in any event limited to direct and foreseeable damages. As the Service is free of charge, no compensation shall be due in respect of its use.
Content published by users (banner photos, welcome messages) remains the property of its authors. By publishing such content on MagicListe, the user grants the Publisher a non-exclusive, free and limited license to display this content as part of the operation of the Service.
All other elements of the site (design, code, logo, the name "MagicListe") are the exclusive property of the Publisher.
The Publisher reserves the right to modify these Terms at any time. Changes take effect upon their publication on the site. Use of the Service after the publication of amended Terms constitutes acceptance of the new terms.
In the event of a substantial change, users with a contact email will be informed by email.
These Terms are governed by French law. In the event of a dispute relating to the interpretation or performance of these Terms, the parties shall endeavor to reach an amicable solution. Failing this, the dispute shall be submitted to the competent courts of Paris, France.
